Significant Developments for Investment Advisers under ERISA and the Marketing Rule

Ryan Walter, Esq. and Cary Kvitka, Esq., Founders and Partners, RIA Lawyers LLC.

PTE 2020-02, which is now in effect, presents challenges and potential opportunities for registered investment advisers, including when considering or recommending rollovers. This has caused significant confusion about what triggers reliance on PTE 2020-02, and exactly how to comply in the face of real-world limitations. At the same time, the transitional period for Rule 206(4)-1 is ending in November. This prompts registered investment advisers to update their advertising and marketing policies and procedures and act accordingly, which can be daunting in the face of a new and untested regulation. This presentation will offer pragmatic options to tackle these major regulatory shifts, from two attorneys who focus their practice almost entirely on registered investment advisers.

Congress has been actively moving toward passage of legislation amending the tax code and ERISA to make extensive changes to the laws governing retirement saving, pensions, 401(k) plans, and IRAs.  We will cover the highlights of these pending changes, which stand a good chance of enactment before year-end.

Succession Planning: Panel Discussion

Moderator:  Chris Benson, CPA/PFS, Principal, L.K. Benson & Company

Panelists:

David Berman, CFP, CLU, CEO, Berman McAleer

Pamela Gilmour, RICP, CLU,CHFC, CEO, Financial Fitness

Gregory Horning, CPA, PFS,  Director, SC&H Group, Inc.

We routinely advise our clients on how to plan for their succession, so we need to walk that talk. It can take years to craft the contract and find the right future owners. It is never too early to create teams of professionals to make the financial advisor’s exit seamless, as well as create income streams to compensate his family for his life’s work

3:40 pm - 4:30 pm
Rinse and Repeat, or an Entirely New Game? What’s Really Changed about Baltimore and its Civic Agenda?

Shanaysha Sauls, Ph.D., President & CEO, Baltimore Community Foundation

Questions about the future of Baltimore run the gamut—from population decline, neighborhood renewal and reigniting downtown to reinvigorating small businesses, tackling our history of racial and ethnic segregation and reviving versions of regionalism.  Many of these challenges feel too familiar and often intractable.  One thing that has changed is that there is more—and more diffuse—personal wealth available to make an impact than ever, including in the Baltimore region. Another is how we view our leaders. In light of the stakes and current context, what risk and opportunities are before us, what could actually make a difference, and how can those who are committed and passionate about Baltimore participate?
